Order for Questioning This application results in the court ordering a judgment debtor’s personal attendance at court to answer questions under oath as to their ability to pay the judgment debt. The judgment debtor will be required to bring financial documentation with them to court, such as statements for all bank accounts that they hold. After being questioned under oath, the judgment creditor will be in a position to better enforce the CCJ.
In the event that a judgment debtor simply fails or refuses to attend court under these orders, the courts usual sanction is to issue an arrest warrant and order that they be placed in prison for 7 days. After that, they then still have to attend court for questioning, otherwise the process will continue repeating itself.
